Terms of Use and License
Last updated: October 2026
These Terms of Use and License ("Terms") govern your use of PodFlip, software published by Trivera Interactive, Inc. ("Trivera", "we", "us"). By installing or using PodFlip, you agree to these Terms.
1. License grant
When you purchase PodFlip, Trivera grants you a perpetual, non-exclusive, non-transferable license to install and use PodFlip on up to five (5) computers that you own or control (five activations), for your own internal or business purposes. This is a one-time purchase. There is no subscription and no recurring fee for the license itself.
You may not resell, sublicense, rent, lease or redistribute PodFlip, or reverse engineer it except to the extent such restriction is prohibited by law.
2. Your ElevenLabs account
PodFlip requires your own ElevenLabs account and API key to generate audio. You are solely responsible for:
- creating and maintaining your ElevenLabs account;
- all usage and charges billed by ElevenLabs in connection with your use of PodFlip;
- complying with ElevenLabs' own terms of service, usage policies and voice consent policies.
Trivera is not a party to your agreement with ElevenLabs and has no visibility into, or control over, your ElevenLabs billing.
3. Your content and your voices
You are solely responsible for the scripts, transcripts and other content you process with PodFlip, and for having all necessary rights, permissions and consents for that content and for any voices you use with it, including rights to use any ElevenLabs voice (including a cloned or custom voice) for the purpose you use it.
4. Prohibited uses
You agree not to use PodFlip to:
- impersonate a real person, or generate a voice of a real person, without that person's knowledge and consent;
- create deceptive, fraudulent, defamatory or unlawful content;
- violate any applicable law or the rights of any third party.
5. No warranty
PodFlip is provided "as is" and "as available," without warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement. Trivera does not warrant that PodFlip will be uninterrupted or error-free, or that the output of any particular generation will meet your expectations.
6. Limitation of liability
To the maximum extent permitted by law, Trivera will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, arising out of or related to your use of PodFlip, even if advised of the possibility of such damages. Trivera's total liability for any claim arising out of or related to PodFlip will not exceed the amount you paid for your PodFlip license.
7. Payment and billing through our reseller
Purchases of PodFlip are processed by Trivera's authorized reseller, a third-party payment processor that handles payment, billing and related customer service for the purchase. Your payment information is collected and processed by that reseller, not by Trivera directly. See our Privacy Policy and Refund Policy for more detail.
8. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above. Continued use of PodFlip after a change means you accept the updated Terms.
9. Governing law
These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict of laws principles.
